curiousmurf Posted June 28, 2008 Posted June 28, 2008 After a long time on the phone negotiating a deal with a large retailer ( I don't want to name them here because i'm still negotiating with them...) I was able to negotiate 4 Pioneer 508xda for myself/family/friends for $2,500 each. I put a $500 deposit down for 2 and told them the two friends will contact them today to put in their deposit. I was told all 4 units will get installed by Pioneer next week or the following weeks. Today they ring back and said they gave me the price based on the wrong model and that they are out of stock on the 508xda. I told them to call back at a more convenient time to talk.... What can i do ? Please help with any creative ideas ?

If not, maybe inquire with Dept of Fair Trading or equivalent in your state. J.
Mining Man Posted June 28, 2008 Posted June 28, 2008 ~What can i do ? ... I suspect nothing. He offered you a product the manufacturer has discontinued, so the price negotiated is moot. If he was reneging on the price of an available product, then that might be a different thing. It might be worth seeing if the equivalent discount (either in full, or relative %) can be given off another model.
WhiteGuM Posted June 28, 2008 Posted June 28, 2008 Its more than likely that they can't supply them as the few left which are coming into Australia are mostly spoken for. In this case all you are really entitled to is a full refund.

Just a fact of life. You can't line someone up in your sites just because of a misunderstanding. Which it obviously was because 508xda's haven't been able to be ordered in for nearly two months. * What is it with the term MOOT this year? Seems every man and his dog ddecided to use it for 2008. Kinda flavour word of the month. I understand its meaning but its apparent many previously didn't by the way it's being used flagrently, lol. Edited June 28, 2008 by tuckerm
Mining Man Posted June 28, 2008 Posted June 28, 2008 Nothing you can do. Misinterpretations and misunderstandings happen all the time. The sale's not over 'till' the Fat Lady sings...~ Not true. A sales contract is just that - a contract. In this case, the retailer gets out of it because they are unable to supply the goods detailed in the contract. The fact that a deposit was taken means the contract (in this case, a verbal one) stands as legally binding, in all other scenarios where the goods were available. ~* What is it with the term MOOT this year? While checking up on the meaning of words to determine the appropriateness of their use / misuse, you may as well do a spell check.
diesel Posted June 28, 2008 Posted June 28, 2008 Totally agree with Mining Man. Goods are not available, so the best they can do is offer a full refund, or an equivalent product. Alternately, you can renegotiate on the LX508.
-SDU- Posted June 28, 2008 Posted June 28, 2008 im not sure of your rights, but i can tell you straight from pioneer direct that the 508XDA is discontinued and they themselves are worried they wont have enough stock to fulfil existing orders the cost price of the LX is $3850 which ive just been able to pick one up for after whinging about the 508 availablility (been waiting 3 months after bring told the same "2 weels" as you) so push for something similar if you have the $
